Who we are
The website and nQX Talent are provided by Novargo, Malta ("we", "us"). You can reach us at connect@novargo.com.
Using the website
You may use the website to learn about nQX Talent, watch the tour and ask for a demo. Everything on it is general information. In particular, anything we say about employment law or HR practice is there to help you understand the subject; it is not legal advice, so check your own situation with an adviser.
We work to keep the website accurate and available, but we cannot promise that it is free of errors or always online.
Your organisation's agreement
Organisations use nQX Talent under an agreement with us: an order or subscription and the terms it refers to, including our Data Processing Terms. If you use nQX Talent through your employer or another organisation, that organisation is our customer and its agreement governs the service. If these terms and that agreement differ, the agreement applies.
Accounts
Your organisation's administrators invite you and decide what your role lets you see and do. Keep your password to yourself, and choose a strong one that you do not use anywhere else. If you think someone else has used your account, tell your administrator or us straight away.
Administrators are responsible for giving access only to people who should have it, for choosing their roles, and for removing access when someone leaves.
Acceptable use
You must follow our Acceptable Use Policy. In short: use nQX Talent only for your organisation's legitimate performance and people management, stay within the access you were given, and do nothing that harms the service, other users or other customers.
Your organisation's data
The information your organisation and its people put into nQX Talent belongs to your organisation. We use it only to provide the service, as our Privacy Policy and Data Processing Terms describe. Your organisation can export it at any time while its agreement is in force.
You confirm that you are allowed to put into nQX Talent whatever you put in, and that it breaks no law and no one else's rights.
Ratings, bonuses and notice periods
nQX Talent works out ratings, bonus figures, notice periods and reports from the rules, weights, scales and data your organisation sets. Your organisation chooses those settings, is responsible for checking the results, and makes every decision about its people.
Statutory notice periods follow Malta's Employment and Industrial Relations Act (Chapter 452) as we understand it. They are a help, not legal advice. If a figure looks wrong, tell us and we will look into it.
Document verification
Documents exported from nQX Talent carry a verification code. Our verification page confirms whether a document was produced by nQX Talent for the organisation it names, and whether a file you check is unchanged. It does not confirm that what the document says is correct; that remains the responsibility of the organisation that issued it.
Our intellectual property
nQX Talent and the website, including the software, designs, text, the tour video and the nQX name and logo, belong to Novargo or to those who license them to us. Your organisation's data is not ours and is not covered by this section.
While your organisation's agreement is in force, you may use nQX Talent for its internal purposes. You may not copy, sell, rent, modify or reverse engineer it, except where the law expressly allows. If you send us ideas or suggestions, we may use them freely.
Changes and availability
We keep improving nQX Talent and may change or remove features. We will not make a change that materially reduces what a customer has paid for during its term without telling it first.
We work to keep the service available, but it may sometimes be interrupted, for example for maintenance or for reasons outside our control. Where we can, we announce planned maintenance in advance.
Suspension
We may suspend an account or limit access when it is needed to protect the service, other customers or the law, for example if an account seems to be compromised or these terms are seriously broken. Where we can, we tell the person or organisation first, and we restore access as soon as the problem is solved.
Liability
The website is provided free of charge and as it is. As far as the law allows, we are not liable for any loss that comes from using it or relying on it.
For customers, our responsibilities and liability are set out in their agreement with us. Nothing in these terms limits liability that cannot be limited by law, such as liability for fraud, or for death or personal injury caused by negligence.
Links to other websites
The website links to other sites, such as official sources of law. We are not responsible for what they say or how they handle your data.
Changes to these terms
We may update these terms. The date at the top shows when they last changed. If a change matters to our customers, we tell them in advance. Using the website or the app after a change means you accept the updated terms.
Law and courts
These terms are governed by the laws of Malta, and the courts of Malta decide any dispute about them, unless your organisation's agreement with us says otherwise.
